On 1st December 2021, the European Commission presented a proposal for a regulation on the digitalisation of judicial cooperation and access to justice in cross-border civil, commercial and criminal matters.
The proposal aims to alleviate problems regarding the lack of digital tools supporting the cooperation between legal systems in different EU Member States, and the lack of digital tools facilitating access to justice in cross-border cases, as well as possible issues concerning the recognition of certain electronic communication means used in judicial proceedings. In general, the objective of the proposal is to aid access to justice and the efficiency of cross-border judicial cooperation. To do so, the European Commission is proposing the creation of a digital communication channel which will enable the facilitation of digital tools in cross-border judicial cooperation proceedings.
The file is currently being considered by the preparatory bodies in the Council and in the European Parliament.type: Proposal for a Regulation
